Terms of Service

These Terms of Service ("Terms") govern your use of the Ansius website and services ("Service"), including Ansius Hirewall, CV matching tools, job posting services, and related features. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
1. Eligibility and Account Registration
- You must be at least 18 years old or have the legal capacity to enter into these Terms in your jurisdiction.
- To use certain features of the Service, you must create an account and provide accurate, current, and complete information.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account or any other breach of security.
- You may not create multiple accounts to circumvent service limits or restrictions.
- We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or harmful activity.
2. User Content and Responsibilities
- You retain ownership of any CVs, job descriptions, or other content you upload ("User Content").
- You grant us a license to process, store, and display your User Content for the purpose of providing and improving the Service, including sharing application data with employers when you apply for jobs.
- You represent and warrant that you have the necessary rights, permissions, and authority to upload and use such content, and that your User Content does not infringe any third-party rights.
- You are responsible for ensuring that your User Content is accurate, lawful, and does not contain false, misleading, or fraudulent information.
- We reserve the right to remove or refuse to process User Content that violates these Terms or applicable law, but we are not obligated to review all User Content.
Job Posting Responsibilities (for Employers/Recruiters)
- If you post jobs through Ansius Hirewall, you are responsible for ensuring that job postings are accurate, lawful, and comply with applicable employment and anti-discrimination laws.
- You must not post jobs that discriminate on the basis of protected characteristics (e.g., race, gender, age, religion, disability) unless such discrimination is legally permitted and necessary for the role.
- You are responsible for ensuring that job postings do not contain false, misleading, or fraudulent information.
- You acknowledge that Ansius does not verify the accuracy of job postings or the legitimacy of employers, and candidates apply at their own risk.
2a. Data Processing Relationships
For Candidates Applying to Jobs: When you apply for a job through Ansius public job pages, Ansius collects and processes your application data. Ansius acts as a data controller for hosting the job pages and collecting your data. Your application data is also shared with the employer or recruiter who posted the job, who acts as a separate controller for evaluating your candidacy. Please review our Privacy Policy for details about how Ansius processes your data.
For Employers/Recruiters Using Hirewall: When you use Ansius Hirewall to post jobs and manage candidates, you are the data controller for candidate data used for recruitment purposes. Ansius processes candidate data on your behalf as a data processor. This relationship is governed by our Data Processing Agreement, which forms part of these Terms. By using Hirewall, you agree to the Data Processing Agreement and acknowledge your responsibilities as a data controller under applicable data protection laws.
3. Data Protection and Privacy
Your use of Ansius is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data. If you are an employer or recruiter using Hirewall, you are also subject to our Data Processing Agreement, which governs how we process candidate data on your behalf.
By using Ansius, you agree to comply with applicable data protection laws, including GDPR where applicable. If you are an employer or recruiter, you are responsible for ensuring you have a valid legal basis for processing candidate data and for providing appropriate privacy notices to candidates.
4. Payments and Refunds
- Payments are processed securely via Stripe. By making a purchase, you agree to Stripe's terms and policies.
- All fees are stated in USD unless otherwise specified. Prices may change at any time, but changes will not affect purchases already completed.
- All fees are non-refundable except as required by law or as explicitly stated in our refund policy.
- If you are located in a jurisdiction that provides statutory refund rights (e.g., EU consumer protection laws), those rights remain unaffected.
- If you believe you are entitled to a refund, contact us at hello@ansius.com with details of your purchase and the reason for the refund request.
- We reserve the right to refuse or limit refunds in cases of abuse, fraud, or violation of these Terms.
5. Acceptable Use and Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Upload content that infringes any intellectual property, privacy, or other rights of third parties
- Upload false, misleading, or fraudulent information, including fake CVs, job postings, or application data
- Attempt to disrupt, interfere with, or compromise the security, integrity, or availability of the Service
- Use automated systems, bots, or scripts to access or use the Service without our express written permission
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use the Service to spam, harass, or harm other users
- Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
- Collect or harvest information about other users without their consent
- Use the Service to compete with Ansius or to build a similar or competing service
We reserve the right to investigate violations of these Terms and may involve law enforcement authorities where appropriate. Violations may result in immediate termination of your account and legal action.
5a. API Usage (Hirewall API)
If you use the Ansius Hirewall API:
- You must use a valid API key and comply with rate limits and usage restrictions
- You may not share your API key with third parties or use it in a way that circumvents intended usage limits
- You are responsible for securing your API key and for all usage associated with your key
- We reserve the right to revoke API access for violations of these Terms or excessive usage
- API usage is subject to the same data protection and privacy obligations as other Service usage
6. Intellectual Property
- All content, features, functionality, and materials provided by Ansius (excluding User Content) are the property of Itinair Ltd or its licensors and are protected by copyright, trademark, and other intellectual property laws.
- You may not copy, modify, distribute, sell, lease, or create derivative works from our content, code, or Service without our express written permission.
- The Ansius name, logo, and trademarks are our property and may not be used without our permission.
- You retain ownership of your User Content, but grant us a worldwide, non-exclusive, royalty-free license to use, process, and display your User Content as necessary to provide the Service.
7. Service Availability and Modifications
- We strive to provide reliable service but do not guarantee that the Service will be available at all times or free from errors, interruptions, or security issues.
- We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.
- We may perform scheduled maintenance that temporarily limits Service availability.
- We are not liable for any loss or damage resulting from Service unavailability or modifications.
8. Third-Party Services
The Service may integrate with or link to third-party services, including:
- Payment processors (e.g., Stripe) for payment processing
- Cloud storage and database providers (e.g., Google Firebase) for data storage
- Language model providers (e.g., OpenAI, Google) for AI analysis
- Authentication providers (e.g., Google Auth) for account access
- Analytics providers (e.g., Firebase Analytics, Vercel Analytics, Hotjar) for usage analytics
- Hosting providers (e.g., Vercel) for hosting the Service
Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or policies of third-party services. Some third-party services use cookies and similar tracking technologies as described in our Privacy Policy.
9. Account Termination
- You may terminate your account at any time by contacting us at hello@ansius.com.
- We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if we determine that your use of the Service poses a risk to us or other users.
- Upon termination, your right to use the Service ceases immediately, but provisions that by their nature should survive termination (including data protection obligations, indemnification, and limitation of liability) will continue to apply.
- We may delete your account data after a reasonable period following termination, subject to legal retention requirements.
10. Warranties and Disclaimers
- The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We do not warrant that the Service will be uninterrupted, secure, error-free, or free from viruses or other harmful components.
- We do not guarantee the accuracy, completeness, or reliability of any results, analysis, or information generated by the Service.
- All information, suggestions, and AI-generated content provided by the Service should be verified by you. You bear full responsibility for any use of such information and any consequences arising from it. Ansius and Itinair Ltd cannot accept any responsibility or liability for actions taken based on information, suggestions, or AI-generated content provided by the Service.
- We do not guarantee that job postings are accurate, legitimate, or that employers will respond to applications.
- We do not guarantee that candidates will be suitable for positions or that hiring decisions will be correct.
11. Limitation of Liability
To the fullest extent permitted by applicable law:
- Ansius and Itinair Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.
- Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve months preceding the claim, or £100, whichever is greater.
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Ansius, Itinair Ltd, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property or privacy rights
- Your User Content or job postings
- Your hiring decisions or treatment of candidates
13. Export Restrictions
You agree to comply with all applicable export and import laws and regulations. You may not use or export the Service in violation of any applicable laws or regulations, including but not limited to export restrictions imposed by the United Kingdom, European Union, or United States.
14. Dispute Resolution
If you are located in the European Union or United Kingdom, you may have the right to bring disputes before the courts of your country of residence or before the courts of England and Wales, depending on applicable law.
For all other users, these Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Before initiating formal legal proceedings, we encourage you to contact us at hello@ansius.com to attempt to resolve disputes informally.
15. Force Majeure
We shall not be liable for any failure or delay in performance under these Terms resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, labor disputes, internet or telecommunications failures, or government actions.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
17. Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms or our rights and obligations without restriction.
18. Entire Agreement
These Terms, together with our Privacy Policy and Data Processing Agreement (where applicable), constitute the entire agreement between you and Ansius regarding your use of the Service and supersede all prior agreements and understandings.
19. Changes to Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will notify you of material changes by:
- Posting the updated Terms on this page with an updated "Effective Date"
- Sending an email notification to registered users for significant changes (where required by law)
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may terminate your account.
